The attorney for the governor’s office is expecting a lawsuit over the capacity limits.
Chief Legal Counsel Ryan Nilsestuen calls it a “very targeted order,” and says it uses authority that wasn’t part of the state Supreme Court’s “safer at home” decision.
He says they used capacity as the basis for the limits on gathering sizes because capacity totals are already in place for buildings across the state. Nilsestuen says local fire inspectors set the capacity for buildings.
